KVS Is Unable To Refuse Admission Under The EWS Category For A Certificate From A Different State: HC

The Delhi High Court has held that the Centre, which is in charge of the Kendriya Vidyalaya Sangathan (KVS), is the proper government to notify the yearly income level for determining whether a kid is eligible for the economically weaker segment (EWS).

According to the statement, the KVS is not allowed to refuse admission to an EWS student just because their income certificate was received from a different state rather than the Delhi government.

According to Justice Anup Jairam Bhambhani, the central government has notified that an officer in the state not lower than the rank of tehsildar is required to issue a certificate for that purpose, following the procedures set forth by the respective state governments and meticulously examining all pertinent documentation.

The high court declared, "It is untenable that KVS rejected the petitioner's ward's admission on the grounds that the EWS certificate was obtained from the State of Uttar Pradesh and not from the Government of NCT Delhi."

The high court overturned the government's January 3, 2022 letter rejecting admission and granted a man's appeal asking KVS (Delhi area) to admit his son under the EWS category to a Kendriya Vidyalaya in the nation's capital.
