Supreme Court Orders UGC Regulations

The Supreme Court has ordered universities to comply with the University Grants Commission (UGC) guidelines.

 

The orders were decreed by the Supreme Courts in light of the reinstatement of the permanent teachers at Jamia Millia Islamia (“University”) who were denied regularisation by the University. Even though the teachers have served the UGC's letter to the University ordering regularisation of them, they were selected through an authorised selection process and have the required qualifications.

 

The official judgement reads, “Considering that appellants were appointed after undergoing a regular selection process and they possess relevant qualifications as per the norms of UGC, they should have been continued on the posts merged with the regular  Civil Appeal @ SLP(C) 8333 of 2023 Page 19 of 20 establishments of the University instead of adopting a fresh selection procedure. In the facts of this case, the University's action of not continuing them and starting a fresh selection process is unjust, arbitrary and violative of Article 14 of the Constitution of India. Therefore, the employment of the appellants will have to be continued after the merger.”
